Waiver and Release of Liability Agreement

By signing this Waiver and Release of Liability Agreement, I waive and release Tomato Foster Club, its agents, volunteers, representatives, successors, and assigns from any and all claims, demands, causes of action, damages, or suits at law or in equity of any kind, including but not limited to claims for personal injury, property damage, medical expenses, or loss of services, arising from or in any way related to my participation in any activities or events hosted by Tomato Foster Club, including entry into any cat lounge or event space.

This waiver and release is intended to, and does, release Tomato Foster Club from all liability for damages or injuries related to or arising out of the negligence of third parties, and from any liability related to its own intentional conduct.

I further covenant and agree not to institute any claims or legal action against Tomato Foster Club for any matter released by this Agreement. I also agree that, should any such claim be brought against Tomato Foster Club, including but not limited to derivative claims, I will indemnify and hold harmless Tomato Foster Club from any resulting liability or expense, including attorney’s fees and costs incurred in defense of such claims.

I understand that Tomato Foster Club is not responsible for any lost, stolen, or damaged personal property.

I have read and understood this Agreement. By signing below, I acknowledge that I consent to be bound by its terms, including the waiver and release of any legal right I may have to bring a claim against Tomato Foster Club. I understand that any violation of this Agreement, as determined by Tomato Foster Club, may result in immediate termination of my participation and revocation of access to its facilities or events.
